Million Dollar Putt: You vs. Vegas

1. ELIGIBILITY: Top-Flite D2 Million Dollar Putt: You vs. Vegas (the "Sweepstakes") is open only to legal residents of the fifty (50) United States and the District of Columbia (excluding Puerto Rico) who are twenty one (21) years of age or older at the time of entry (proof of age and residency may be required). Void outside of the United States and where prohibited, and where restricted in a manner not satisfied by the publication of these Official Rules on this website. Employees, officers, directors and agents of Callaway Golf Sales Company, its parent, subsidiaries and affiliates, advertising, promotion, fulfilment or any other agencies or entities involved with this Sweepstakes and members of their immediate families (spouse, parents, siblings, children and their respective spouses) and/or those residing in the same household (whether related or not) of each of the above are not eligible to enter or win. Also specifically excluded from entry are current or former professional golfers, and current or former high school varsity or NCAA intercollegiate golfers that have played in a high school varsity golf tournament within the past three (3) years or NCAA intercollegiate golf tournament within the past five (5) years (eligibility is subject to verification). The Sweepstakes is subject to and governed by all applicable United States laws and regulations.
2. SPONSOR: The Sweepstakes is sponsored by Callaway Golf Sales Company, 2180 Rutherford Road, Carlsbad, CA 92008-7328 (the "Sponsor").
3. AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning the Grand Prize (as defined below) is contingent upon fulfilling all requirements set forth in these Official Rules, as determined by Sponsor in its sole discretion.
4. ENTRY PERIOD: The Sweepstakes begins June 1, 2007 at 12:00:01 AM (PST) and ends July 15, 2007 at 11:59:59 PM (PST) (the "Entry Period"). Entries submitted prior to or after the Entry Period will be disqualified.
5. TO ENTER: Visit during the Entry Period, complete the online Sweepstakes registration form to enter the Sweepstakes drawing; limit one (1) entry per person per day. Entrants must provide first and last name, a valid email address, complete mailing address and phone number. Upon completion of the form, click the "submit" button to send the entry. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Sponsor may, at its option, require satisfactory proof of email account ownership. Sponsor is not responsible for late, lost, illegible, incomplete, misdirected entries; interrupted or unavailable network servers or other connection problems; failed phone or computer transmissions, or technical failure; jumbled, scrambled or misdirected transmissions; or other error of any kind, whether human, mechanical or electronic, that may hinder or void your attempted Sweepstakes registration and subsequent entries. All entries become the exclusive property of Sponsor, and none will be acknowledged or returned. Your use of any automated sweepstakes or contest entry system, or a professional sweepstakes or contest entry agent, to submit entries in the Sweepstakes is prohibited and will result in disqualification.
6. DRAWING: Potential winner will be selected at random on or about July 20, 2007 from all eligible entries received during the Entry Period. The drawing will be conducted on Sponsor's behalf by Interactive Games, an independent judging organization whose decisions as to the administration of the Sweepstakes and the selection of the potential winner are final. Actual odds of winning depend on the number of eligible entries received. Entrant selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements, including, but not limited to traveling on dates specified by Sponsor. The potential winner will be notified by e-mail, mail or phone within two (2) days of the drawing. Except where prohibited, the potential Grand Prize winner and the winner's guest must sign and return to Interactive Games, within three (3) days of being notified, an affidavit of eligibility and liability/publicity release in order to claim his/her Grand Prize. If the potential winner cannot be contacted within three (3) days after the first attempt to contact him/her, or, where allowed by law, if he/she fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, an alternate entrant will be selected in his/her place at random from among all eligible entries received. Failure to travel and participate in the Grand Prize package on dates specified will result in forfeiture of total Grand Prize package and an alternate Grand Prize winner will be selected. If the potential winner's guest is a minor (under eighteen (18) years of age), his/her parent or guardian must sign the Affidavit/Release on his/her behalf.
7. GRAND PRIZE ("GRAND PRIZE"): Upon certification by Sponsor as an eligible participant, one Grand Prize winner will be awarded a three night/four day vacation for two to Las Vegas, Nevada, from August 8, 2007 through August 11, 2007 (including travel days). The Grand Prize vacation includes round trip coach airfare for two (winner plus guest) on Sponsor-designated airline; three nights' accommodation at the Treasure Island Hotel (one room/double occupancy); four days full size car rental (if winner is under twenty five (25) years of age a $100.00 a day transportation allowance will be provide in lieu of car rental); and one (1) chance at a Million Dollar Putt (see Putt Terms and Conditions below). Originating airport will be the major airport served by designated carrier closest to the winner's residence. Winner and guest must travel on the same itinerary. Travel must be on Sponsor's designated dates and is subject to change at Sponsor's discretion. All expenses not specified are the sole responsibility of winner including, but not limited to, all taxes, fees, insurance, food, gratuities, incidentals and transportation to and from originating airport. The approximate retail value ("ARV") of the Grand Prize is $3,500.00 ($1,750.00 ARV per person). Value may vary depending on originating airport. The Grand Prize is not transferable or refundable and must be accepted as awarded. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute another prize of equal or greater value if the Grand Prize is not available for any reason as determined by the Sponsor in its sole discretion. The winner and his/her guest are responsible for payment of all taxes associated with receipt or use of the Grand Prize ($1,750.00 ARV per person); an IRS Form 1099 will be issued to the Grand Prize winner and his/her guest. Entry in this Sweepstakes constitutes each entrant's agreement to pay all applicable taxes and comply with all laws.
a. The Grand Prize winner will be provided one (1) attempt to sink a putt with a single official stroke (the "Putt") as defined by and in accordance with the USGA® 2006-07 Rules of Golf ("Rules of Golf") and the local rules ("Local Rules") established by the Sponsor in its sole discretion. Once the golf ball is struck, the Grand Prize winner may not interfere with (e.g., by blowing, fanning, sweeping, forcing or otherwise influencing) the path of the Putt or the progress of the ball.
b. The Putt will take place at the Treasure Island Hotel, Las Vegas, Nevada, on August 9, 2007, at or about 7:30 PM.
c. The Putt shall be taken from a distance of approximately forty (40) feet on a putting surface constructed for this contest. Pin placement, putting location, putting surface materials and slope/grade of putting surface are at Sponsor's sole discretion. The condition of the putting surface may vary based, among other things, on weather conditions, construction materials used and/or naturally occurring or manufacturing variances -- e.g., seams, grain, lay of grass, etc. -- (collectively, "Putting Surface Variances").
d. The Grand Prize winner must attempt the Putt him/her-self; another person may not putt on behalf of the Grand Prize winner.
e. The Grand Prize winner will be allotted three (3) minutes in which to commence the Putt attempt. Failure to attempt the Putt within this time limit will result in disqualification.
f. A Putt that does not travel a distance of five (5) feet will be considered a false start ("False Start") and the Grand Prize winner will be allowed to putt again from the original putting location. Only one (1) False Start is permitted.
g. A Putt attempt that leaves the confines of the putting surface at any time will be considered a missed putt, thereby ending the contest.
h. A Putt attempt that is physically obstructed by any person or object shall be considered a missed putt, thereby ending the contest. However, if the judges determine, in their sole and absolute discretion, that the Grand Prize winner was not responsible in any way, directly or indirectly, for the obstruction, the Grand Prize winner may be allowed another attempt from the original putting location. For purposes of this provision, Putting Surface Variances shall not be considered obstructions entitling the Grand Prize winner to another putt attempt.
i. The Putt attempt will be videotaped for potential use on television, the Internet or other forms of visual media.
j. All equipment (including the putter and golf ball to be utilized for the Putt) shall be provided by Sponsor.
k. Distractions, including, but not limited to, spectator activities, audio (music and other loud noises) and visual (movement of people and objects) will occur during the Putt attempt and are not conditions entitling the Grand Prize winner to repeat the Putt.
l. No practice attempts are allowed on the surface where the Putt will take place at any time on or prior to the day of the Putt.
m. An independent judging organization, whose decision on all matters of the Putt contest is final, will conduct the contest, verify the attempt and, if applicable, declare the winner.
n. The Grand Prize for a successful Putt is One Million Dollars ($1,000,000.00) payable in forty (40) annual installments of Twenty Five Thousand Dollars ($25,000) each; the installment payments shall be made by a third party administrator. The winner will be given a qualified prize option to accept a single lump sum payment in the amount of Four Hundred Fifty Thousand Dollars ($450,000.00) in lieu of the above payments to which he/she would otherwise be entitled. Payment of the Grand Prize money shall be administered by HCC Specialty Underwriters.
o. The consolation prize to the Grand Prize winner for a failed Putt attempt is One Thousand Dollars ($1,000.00).
q. The Grand Prize winner understands that his/her participation in the One Million Dollar Putt attempt will forfeit his/her amateur golf status under the Rules of Golf.
9. PUBLICITY: Except where prohibited, participation in the Sweepstakes constitutes the Grand Prize winner's consent to the Sponsor's use of the Grand Prize winner's name, voice, likeness information and state of residence for the purpose of advertising, trade or promotion, in any media throughout the world, including, but not limited to, television and the Internet (including all rebroadcasts), without further payment or consideration.
10. GENERAL CONDITIONS: No purchase necessary nor shall a purchase increase odds of winning. In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, that may cause the Sweepstakes to be disrupted or corrupted, the Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the unclaimed Grand Prize at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, the operation of the Sweepstakes, or acting in violation of these Official Rules, as determined by Sponsor. Any attempt by any person to undermine the legitimate operation or administration of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of any other provision of these Official Rules. The Grand Prize winner may be required to execute acknowledgement documents provided by Sponsor or Sponsor's representatives prior to participating in the One Million Dollar Putt.
11. RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, entrant agrees to release and hold harmless Callaway Golf Sales Company, its parent, subsidiaries and affiliates, advertising, promotion, fulfilment, judging or any other agencies or entities involved with this Sweepstakes and their respective employees, officers, directors, shareholders and agents (the "Released Parties") from and against any claim or cause of action arising out of participation by entrant in the Sweepstakes, or receipt or use of any prize by the Grand Prize winner or his/her guest, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, misdirected, or undeliverable entries (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation by entrant in the Sweepstakes or receipt of any prize by the Grand Prize winner or his/her guest. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, incidental, consequential, direct, or indirect damages. Entrants acknowledge that neither Sponsor nor its agents have made or are in any manner responsible or liable for any representation, guarantee or warranty, expressed or implied, in fact or in law, relative to the Grand Prize awarded in this Sweepstakes.
12. IRREVOCABLE ARBITRATION OF DISPUTES: Any dispute between entrants or the Grand Prize winner or his/her guest and Sponsor, its parent, subsidiaries and affiliates, advertising, promotion, fulfilment, judging or any other agencies or entities involved with this Sweepstakes and their respective employees, officers, directors, shareholders and agents, that cannot be amicably settled will be finally resolved by binding arbitration in San Diego, California, in accordance with the Comprehensive Arbitration Rules and Procedures of JAMS, and any judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. It is expressly understood that the parties have chosen arbitration to avoid the burdens, costs and publicity of a court proceeding, and the arbitrator is expected to handle all aspects of the matter, including discovery and any hearings, in such a way as to minimize the expense, time, burden and publicity of the process, while assuring a fair and just result. The arbitrator shall allow reasonable discovery as provided in the California Arbitration Act, but shall control the amount and scope of discovery. The arbitration shall be conducted in San Diego by a former or retired judge or attorney with at least 10 years experience in commercial disputes, or a non-attorney with like experience in the area of dispute, who shall have the power to hear motions, control discovery, conduct hearings and otherwise do all that is necessary to resolve the matter. The parties must mutually agree on the arbitrator. If the parties cannot agree on the arbitrator after their best efforts, an arbitrator from JAMS will be selected pursuant to the Comprehensive Arbitration Rules and Procedures of JAMS in San Diego, California. The arbitrator(s) shall award reasonable attorney's fees to the prevailing party when, in their discretion, the arbitrator(s) deem it appropriate. The provisions of this section shall be binding upon the parties.
13. ENTRANT'S PERSONAL INFORMATION: By entering the Sweepstakes, all entrants consent to Sponsor's collection, use and disclosure of personal information to any third party for the purposes of administering the Sweepstakes and, unless otherwise specified, for consumer research and marketing purposes. To the extent permitted by law, upon entering into this Sweepstakes, each entrant agrees to Sponsor's use of his/her personal information, as described in its Privacy Policy located at and to its Legal Statement located at
